These Terms and Conditions (“Terms”) govern your use of this website and your participation in any programme, course, discovery flight, simulator session, event, tour, transportation or related activity (“Services”) provided by Hong Kong Professional Airline Pilots Association Limited (“HKPAPA”, “we”, “us”).
By accessing this website, submitting an enrolment, making any payment, or participating in any Service, you (and, for participants under 18, your parent or legal guardian on your behalf) confirm that you have read, understood and agree to be bound by these Terms in full. If you do not agree, you must not use the website or participate in any Service.
You must be at least 18 years of age to enrol. Participants under 18 require the written consent of a parent or legal guardian, who accepts these Terms (including the assumption of risk, release and indemnity below) on the minor's behalf.
You represent that all information provided to HKPAPA is accurate, current and complete. HKPAPA may refuse, suspend or terminate any enrolment at its sole discretion, including for incomplete or inaccurate information, without liability.
You acknowledge and agree that flight training, discovery flights, simulator sessions, ground school, airside visits, ramp and hangar access, ground transportation and all related activities inherently involve significant hazards. These include, without limitation: aircraft or equipment malfunction, pilot or instructor error, weather conditions, turbulence, hard landings, mid-air and ground collision risk, airspace and airfield hazards, fire, fuel handling, motion sickness, physical and psychological strain, and cross-border road transportation.
You voluntarily choose to participate in the Services with full knowledge of these risks, and you assume all such risks, whether known or unknown, foreseeable or unforeseeable, to the fullest extent permitted by law.
Enrolment in, payment for, or participation in any Service constitutes your express acknowledgement that you understand and voluntarily accept these risks.
To the fullest extent permitted by the laws of the Hong Kong SAR, you irrevocably release, discharge and agree not to make any claim, demand or action against HKPAPA, its directors, officers, members, employees, instructors, examiners, contractors, sub-contractors, agents, volunteers, partner training organisations, aircraft owners and operators, airfield operators and insurers (together, the “Released Parties”) for any loss, damage, injury, cost or expense of any kind — including personal injury, disability, psychological harm, death, property damage or economic loss — arising out of or in connection with any Service, however caused, including where caused by the negligence of any Released Party.
To the fullest extent permitted by law, the total aggregate liability of the Released Parties for any claim not capable of exclusion shall be limited to the fees actually paid by you for the specific Service giving rise to the claim. In no event shall any Released Party be liable for indirect, incidental, consequential, special or punitive damages, or loss of income, opportunity or employment prospects.
Nothing in these Terms excludes, restricts or modifies any liability which cannot lawfully be excluded, restricted or modified under the laws of Hong Kong, including under the Control of Exemption Clauses Ordinance (Cap. 71).
You agree to indemnify and hold harmless the Released Parties from and against all claims, liabilities, damages, costs and expenses (including legal costs on a full indemnity basis) arising out of or in connection with: (a) your breach of these Terms; (b) your negligent or wilful act or omission; (c) your failure to follow instructions, procedures or safety directions; or (d) any claim brought by or on behalf of you or your estate in respect of risks you have assumed under these Terms.
You represent that you are medically and physically fit to participate and that you have disclosed to HKPAPA any condition that may affect your safety or the safety of others. HKPAPA may require evidence of fitness and may exclude any participant from any activity, without refund, where fitness, conduct or safety is in doubt.
You must at all times follow the instructions of instructors, crew and staff, and all applicable safety rules, airfield rules and regulatory requirements. HKPAPA may remove any participant who, in its sole opinion, poses a risk to safety, good order or the reputation of HKPAPA, without refund or compensation.
Alcohol and drugs are strictly prohibited before and during all activities.
Aviation training outcomes depend on individual performance, weather, regulatory authorities and other factors outside HKPAPA's control. HKPAPA makes no representation, warranty or guarantee as to the attainment of any solo flight, licence, rating, assessment result, interview outcome or employment, and no refund or compensation is payable in respect of any outcome not achieved.
All schedules are subject to weather, air traffic control, aircraft availability, maintenance, regulatory action and other operational factors. HKPAPA may postpone, reschedule, substitute aircraft, instructors or venues, or modify programme content at any time. Affected sessions will be rescheduled where practicable; such changes do not give rise to any refund or compensation.
Certain Services take place at partner facilities in Mainland China (including Zhuhai). You are solely responsible for holding valid travel documents (including a Home Return Permit or visa where applicable), complying with the laws of the Mainland, and your own travel insurance. The Released Parties are not liable for any denial of entry or exit, border delay, document issue, or any act of any authority.
HKPAPA and its partner operators maintain insurance required for their operations. You are strongly advised to obtain your own personal accident, medical and travel insurance covering aviation training activities. Participation is at your own risk regardless of the existence or extent of any insurance.
All website content, training materials, curricula, videos and systems are the property of HKPAPA or its licensors and may not be copied, distributed or used for any commercial purpose without prior written consent. The website is provided “as is” without warranty of any kind; HKPAPA does not warrant that it will be uninterrupted or error-free.
All fees are payable in advance and are strictly non-refundable as set out in the Refund Policy, which forms part of these Terms.
These Terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement between you and HKPAPA in relation to the Services. If any provision is held invalid or unenforceable, the remaining provisions continue in full force, and the invalid provision shall be enforced to the maximum extent permissible.
HKPAPA may update these Terms at any time by posting the updated version on this website; continued use or participation constitutes acceptance.
These Terms are governed by the laws of the Hong Kong Special Administrative Region, and you submit to the exclusive jurisdiction of the courts of Hong Kong. If there is any inconsistency between the English and Chinese versions, the English version prevails.
