Terms & Conditions and Legal Disclaimer

Introduction

1.1 These Terms and Conditions govern your use of the HKPAPA website and your participation in any HKPAPA programme, course, discovery flight, training service, or related activity (“Services”). By accessing the website or enrolling in any Service, you agree to be bound by these Terms and Conditions.


1.2 If you do not agree to these Terms and Conditions, you must refrain from using the website or participating in any HKPAPA Service.

Eligibility and Information Requirements

2.1 You must be at least eighteen years old, or have valid parent or guardian consent, to enrol in any HKPAPA programme.


2.2 You represent that all information provided to HKPAPA is accurate, current, and complete. HKPAPA may reject, suspend, or terminate enrolment at its sole discretion.

Nature of Aviation Activities and Assumption of Risk

3.1 You acknowledge and agree that aviation training, including ground school, simulator sessions, flight operations, transportation, and related activities, inherently involves significant hazards and risks. Such risks include, but are not limited to, aircraft malfunction, pilot error, weather conditions, airspace restrictions, turbulence, hard landings, physical strain, psychological stress, and other operational dangers that may result in personal injury, emotional trauma, disability, property damage, or death.


3.2 You understand that such risks cannot be fully eliminated even with proper training, maintenance, and safety precautions.


3.3 By enrolling in any HKPAPA Service, you freely and voluntarily assume all risks associated with participation, whether known or unknown.

Release of Liability and Waiver of Claims

4.1 To the maximum extent permitted under Hong Kong law, you release, discharge, and agree not to make any claim against HKPAPA, its directors, officers, shareholders, instructors, employees, agents, volunteers, affiliates, partners, contractors, third-party aircraft operators, and visiting organisations (“Protected Parties”) arising out of or relating to your participation in any HKPAPA activity.


4.2 This waiver includes claims arising from ordinary negligence, operational decisions, scheduling, and the actions or omissions of third-party aircraft operators or instructors, but does not waive liability for wilful misconduct or fraud where such waiver is prohibited by law.


4.3 You acknowledge that all participation is undertaken at your own risk and that the Protected Parties shall not be liable for delays, cancellations, or changes caused by weather, airspace restrictions, immigration or customs requirements, aircraft serviceability, operational factors, or other circumstances beyond HKPAPA’s control.

Covenant Not to Sue

5.1 You agree that you will not initiate, join, assist, or maintain any legal action, claim, complaint, or proceeding in any jurisdiction against the Protected Parties relating to personal injury, property damage, or loss arising from or connected with your participation in any HKPAPA activity, except where such covenant is prohibited by Hong Kong law.

Indemnity

6.1 You agree to indemnify, defend, and hold harmless the Protected Parties from any claim, demand, action, loss, liability, damage, or expense (including legal fees) arising from your actions, negligence, omissions, breach of these Terms and Conditions, or participation in HKPAPA activities.


6.2 This indemnity extends to claims brought by you, your estate, family members, insurers, or any third party.

Insurance

7.1 HKPAPA provides basic insurance coverage required for participation in flight training activities.


7.2 You acknowledge that such insurance may not cover all risks or losses and may contain exclusions or limitations. You are responsible for obtaining your own additional insurance, including medical, travel, accident, or life insurance, should you consider it necessary.

Third-Party Operators

8.1 You acknowledge that HKPAPA may arrange flight training through independent third-party operators in Hong Kong, Macau, Mainland China, or other jurisdictions. HKPAPA does not own or operate aircraft and does not control operational decisions, aircraft maintenance, instructor selection, or aircrew conduct.


8.2 All aviation activities are subject to the rules, standards, and policies of the applicable operator and aviation authority. HKPAPA disclaims liability for all matters under the control of such operators to the fullest extent permitted by law.

Payment, Refunds, Scheduling, and Student Conduct

9.1 All payments made to HKPAPA are strictly non-refundable and non-transferable unless otherwise required by law or expressly authorised in writing by HKPAPA.


9.2 HKPAPA may modify, postpone, or cancel lessons or programmes due to safety, operational, or regulatory reasons without compensation.


9.3 Students must follow all safety rules, operational instructions, and instructor directions. HKPAPA may suspend or remove any participant for misconduct, unsafe behaviour, or non-compliance, and no refund shall be issued.

Parent or Guardian Consent for Minors

10.1 For participants under eighteen years old, the parent or legal guardian, by enrolling the minor, consents to the minor’s participation in all HKPAPA activities and acknowledges the inherent risks, including those that may result in serious injury or death.


10.2 The parent or guardian accepts all Terms and Conditions on behalf of the minor, including all waivers, releases, indemnity obligations, and covenants not to sue.


10.3 The parent or guardian agrees to be fully responsible for the minor’s conduct and to indemnify HKPAPA for any loss, damage, or liability caused by the minor.

Online Acknowledgement and Binding Acceptance

11.1 When you register for a course, submit an online form, or make payment through the HKPAPA website or other platform, you confirm that you have read, understood, and accepted these Terms and Conditions.


11.2 Your enrolment constitutes a legally binding waiver and agreement enforceable under Hong Kong law, even if no physical signature is provided.


11.3 HKPAPA may rely on electronic records, timestamps, and payment confirmations as conclusive evidence of your acceptance.

Intellectual Property and Website Use

12.1 All content on the HKPAPA website, including text, images, videos, graphics, trademarks, and training materials, is the exclusive property of HKPAPA and may not be copied, reproduced, distributed, or used for any commercial purpose without prior written consent.


12.2 HKPAPA may modify or discontinue website content or features at any time without notice.

Limitation of Liability

13.1 To the fullest extent permitted under Hong Kong law, the total liability of HKPAPA and all Protected Parties for any claim arising out of your participation shall not exceed the fees actually paid by you for the relevant Service.


13.2 The Protected Parties shall not be liable for indirect, consequential, incidental, punitive, exemplary, or special damages, including loss of income or opportunity, even if advised of the possibility of such damages.

Personal Data

14.1 HKPAPA may collect, store, and process personal data in accordance with the Personal Data (Privacy) Ordinance (Cap. 486) and the HKPAPA Privacy Policy.


14.2 By participating, you consent to the use of your data for scheduling, safety, security, operational, and administrative purposes.

Governing Law and Jurisdiction

15.1 These Terms and Conditions shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region.

15.2 Any dispute, claim, or controversy arising out of or relating to these Terms and Conditions or the Services shall be submitted to the exclusive jurisdiction of the courts of Hong Kong.

15.3 If these Terms and Conditions are translated into any language other than English, the English version shall prevail in the event of any inconsistency, ambiguity, or conflict.

Amendments

16.1 HKPAPA may amend these Terms and Conditions at any time. Continued participation or website use after such amendments constitutes acceptance of the revised terms.

Photography, Videography, and Media Usage

17.1 By attending or participating in any HKPAPA activity, event, class, training session, flight training, seminar, or visit, you acknowledge and agree that HKPAPA may film, photograph, record, or otherwise capture your image, voice, likeness, or performance.


17.2 You grant HKPAPA an irrevocable, worldwide, royalty-free licence to use such media for commercial, promotional, educational, marketing, and internal purposes, including publication on social media, websites, advertisements, and printed or digital materials.


17.3 If you do not wish to be filmed or photographed, you must not attend any HKPAPA event or programme, as filming and photography form part of our standard operations and safety documentation.


17.4 HKPAPA is under no obligation to remove or edit any media in which you appear.

Damage, Misconduct, and Improper Use of Equipment

18.1 Students must follow all safety instructions, instructor directions, operational procedures, and applicable rules at all times.


18.2 If a student engages in misconduct, unsafe behaviour, disorderly conduct, or violates any HKPAPA policy, HKPAPA may immediately suspend or remove the student from the programme without refund.


18.3 If a student improperly uses any aircraft, simulator, equipment, facility, or machinery; fails to follow proper procedures; or acts negligently in a manner that causes loss, damage, or operational disruption, the student shall be fully liable for all repair costs, operational losses, administrative charges, and related expenses.


18.4 In such cases, the student may be permanently removed from the course and shall remain liable to pay any outstanding instalments or course fees. No refund or waiver shall be granted.

Instalment Plans and Payment Obligations

19.1 If you enrol in a course using an instalment plan, you acknowledge that the instalment arrangement is merely a payment schedule and does not limit or reduce your obligation to pay the full course price.


19.2 By enrolling, you agree to pay the entire course fee in full, regardless of whether you complete, participate in, or continue with the course, unless HKPAPA expressly agrees otherwise in writing.


19.3 Failure to make instalment payments may result in suspension of training, account termination, late fees, and recovery actions. HKPAPA reserves the right to pursue all outstanding payments through legal means where necessary.

Severability

20.1 If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable under Hong Kong law, such provision shall be deemed modified only to the minimum extent necessary to make it enforceable or, if modification is not possible, deemed severed from the agreement.


20.2 The remaining provisions shall continue in full force and effect and shall not be affected by the invalidity of any particular clause.


20.3 These Terms and Conditions shall continue to prevail and bind all participants to the fullest extent permitted by law.

No Guarantee of Qualification or Outcome

21.1 HKPAPA does not guarantee that any participant will obtain a pilot licence, achieve solo flight, complete any specific number of training hours, pass examinations, or attain any level of competency.


21.2 Progress in aviation training depends on individual ability, weather conditions, aircraft availability, instructor assessment, medical fitness, and regulatory requirements beyond HKPAPA’s control.


21.3 HKPAPA shall not be liable for any loss resulting from a participant’s inability to qualify for or complete any stage of training.

Force Majeure

22.1 HKPAPA shall not be liable for any delay, modification, suspension, or cancellation of any course or activity caused by events beyond its reasonable control, including but not limited to adverse weather, typhoons, maintenance issues, airspace closures, government restrictions, immigration or customs controls, public health events, or failure of third-party operators.


22.2 In such circumstances, no refund or compensation shall be owed, and HKPAPA may reschedule activities at its discretion.

Right to Refuse Service and Remove Participants

23.1 HKPAPA reserves the absolute right to refuse service or remove any participant from a programme if their behaviour, attitude, safety compliance, communication, or conduct is deemed inappropriate, disruptive, disrespectful, unsafe, or detrimental to HKPAPA’s operations or reputation.


23.2 No refund will be issued, and all outstanding fees remain payable in full.

Medical Fitness and Health Responsibility

24.1 Participants confirm they are physically and mentally fit to undertake flight training and related activities and have disclosed any medical conditions that may affect their safety.


24.2 HKPAPA is not responsible for any injury, incident, or training limitation arising from an undisclosed or unknown medical condition.


24.3 Participants are solely responsible for obtaining and maintaining any required aviation medical certificate.

Compliance with Aviation Regulations

25.1 Participants must comply with all applicable rules issued by the Hong Kong Civil Aviation Department (CAD), Mainland aviation authorities (CAAC), European (EASA), United State (FAA), and any other jurisdiction, flight operators, HKPAPA policies, and instructor instructions.


25.2 Failure to comply may result in immediate removal from the programme with no refund.

Immigration, Travel Documents, and Border Requirements

26.1 Participants are solely responsible for ensuring they have valid passports, visas, permits, health documents, and compliance with all entry requirements for Mainland China and Hong Kong.


26.2 HKPAPA is not responsible for any loss, cancellation, or delay arising from immigration or border control issues.

Communication and Notification Acknowledgement

27.1 Participants agree that WhatsApp, SMS, and email are valid and binding communication channels for all scheduling, notices, confirmations, amendments, and operational updates.


27.2 HKPAPA shall not be responsible for unread messages, missed notifications, or communication delays caused by the participant.

Programme Modifications and Pricing Changes

28.1 HKPAPA may modify course content, structure, hours, aircraft type, instructor assignment, training base, or pricing at any time to reflect operational, regulatory, or safety requirements.


28.2 Such modifications do not entitle participants to refunds or fee adjustments.

Attendance, Punctuality, and Student Responsibility

29.1 Participants must arrive on time, meet at designated locations, and comply with transport and immigration arrangements.


29.2 Missed or late lessons will be counted as utilised training time and will not be rescheduled or refunded.

Non-Disparagement and Reputation Protection

30.1 All photographs, videos, audio recordings, written materials, training content, cockpit footage, simulator footage, operational briefings, flight procedures, and any material obtained or created during HKPAPA training or activities (“Training Material”) are strictly confidential and may not be published, uploaded, shared, or distributed on social media, online platforms, messaging applications, or any public channel without the prior written approval of HKPAPA.

30.2 This restriction includes, without limitation, flying videos, cockpit recordings, simulator footage, ATC recordings, restricted-area content, views of security-sensitive areas, and any material captured during flight training in Hong Kong, Zhuhai, Mainland China, or any aviation facility.

30.3 These restrictions are necessary to comply with aviation safety standards, confidentiality requirements, regulatory obligations, and security rules for controlled and restricted areas.

30.4 Participants acknowledge that unauthorised publication of Training Material may constitute a breach of aviation regulations, confidentiality obligations, intellectual property rights, and security protocols.

30.5 If a participant uploads or shares Training Material without approval, HKPAPA may, at its absolute discretion:
(a) remove the participant from the programme without refund; (b) require the participant to immediately delete the content; (c) pursue claims for damages, losses, or regulatory penalties arising from the unauthorised disclosure; and (d) report the matter to relevant authorities or facility operators if required.

30.6 The participant shall be fully liable for any financial loss, reputational damage, operational disruption, regulatory penalty, or legal costs incurred by HKPAPA or its partners resulting from the unauthorised publication or misuse of Training Material.
